Terms and Conditions

Welcome to OzSound Academy! These terms and conditions ("Terms") govern your use of our website, ozsoundacademy.com.au (the "Site"), and your participation in our online music production courses (the "Services"). By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Site or the Services.

OzSound Academy is operated by Soundwave Education Pty Ltd, a company registered in New South Wales, Australia (ABN 12 345 678 901). These Terms constitute a legally binding agreement between you ("User" or "you") and OzSound Academy ("we", "us", or "our"). Your continued use of the Site or the Services after any such changes constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for updates and changes.

Terms of Use

1. Account Registration: To access certain features of the Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete. You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

2. Course Enrollment: Enrollment in our online music production courses is subject to availability and payment of the applicable fees. We reserve the right to refuse enrollment to anyone for any reason. Upon enrollment, you will be granted access to the course materials for the duration specified in the course description. Access may be terminated if you violate these Terms.

3. Payment and Refunds: Course fees are payable in Australian Dollars (AUD). We accept various payment methods, including credit cards and electronic funds transfer. All payments are processed securely. Our refund policy is outlined separately on our website and is incorporated into these Terms by reference. Generally, refunds are only issued in cases of technical issues preventing course access or in accordance with Australian Consumer Law.

4. Course Content: All course content, including videos, audio files, written materials, and software demonstrations, is the intellectual property of OzSound Academy or its licensors and is protected by copyright law. You may not copy, distribute, modify, or create derivative works of the course content without our express written permission. Course content is for your personal educational use only and may not be used for commercial purposes.

5. User Conduct: You agree to use the Site and the Services in a manner that is lawful, respectful, and consistent with these Terms. You may not engage in any conduct that is harmful, offensive, or disruptive to other users or to the operation of the Site or the Services. This includes, but is not limited to, posting or transmitting unlawful, harassing, defamatory, abusive, threatening, harmful, vulgar, obscene, sexually explicit, or otherwise objectionable material of any kind. You also agree not to engage in any activity that could damage, disable, overburden, or impair the Site or the Services, or interfere with any other user's access or use thereof.

Acceptable Use Policy

1. Prohibited Activities: In addition to the general user conduct rules outlined above, the following activities are strictly prohibited:

Using the Site or the Services for any illegal or unauthorized purpose.
Engaging in any activity that infringes upon the intellectual property rights of OzSound Academy or any third party.
Distributing spam or other unsolicited communications.
Attempting to gain unauthorized access to any part of the Site or the Services, or to any other user's account.

Transmitting any viruses, malware, or other harmful code.
Engaging in any activity that could disrupt or interfere with the operation of the Site or the Services.

2. Monitoring and Enforcement: We reserve the right to monitor user activity on the Site and the Services to ensure compliance with these Terms. We may investigate any suspected violations and take appropriate action, including, but not limited to, issuing warnings, suspending or terminating accounts, and cooperating with law enforcement authorities.

3. Reporting Violations: If you believe that another user has violated these Terms, please notify us immediately at support@ozsoundacademy.com.au. We will investigate all reported violations and take appropriate action.

Intellectual Property Rights

1. Ownership: All content on the Site and the Services, including text, graphics, logos, images, audio files, video files, software, and other materials, is the intellectual property of OzSound Academy or its licensors and is protected by copyright, trademark, and other intellectual property laws. We take protection of our intellectual property very seriously. We also respect other creators and request that users do the same.

2. Limited License: We grant you a limited, non-exclusive, non-transferable license to access and use the Site and the Services for your personal educational purposes, subject to these Terms. This license does not grant you any ownership rights in the Site or the Services, or in any of the content therein. Specifically, users are not permitted to make derivative works of the course content or share content outside of the specific course portal.

3. Trademarks: The OzSound Academy name and logo are trademarks of Soundwave Education Pty Ltd. You may not use our trademarks without our express written permission.

4. Copyright Policy: We respect the intellectual property rights of others and expect our users to do the same. If you believe that your copyright has been infringed on the Site or the Services, please notify us at support@ozsoundacademy.com.au and provide us with the following information: (a) a description of the copyrighted work that you claim has been infringed; (b) a description of where the infringing material is located on the Site or the Services; (c) your contact information, including your address, telephone number, and email address; (d) a statement by you that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (e) a statement by you, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner's behalf.

Disclaimer of Warranties

THE SITE AND THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE OR THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE OR THE SERVICES. YOU ACKNOWLEDGE THAT ANY RELIANCE ON SUCH CONTENT IS AT YOUR OWN RISK.

WE DO NOT WARRANT THAT THE USE OF THE SITE OR THE SERVICES WILL LEAD TO ANY SPECIFIC OUTCOME, SUCH AS SUCCESS IN THE MUSIC INDUSTRY.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE SERVICES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

NOTHING IN THESE TERMS SHALL EXCLUDE OR LIMIT OUR LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE, OR FOR FRAUD OR FRAUDULENT MISREPRESENTATION.

Certain legislation, including the Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth), may imply guarantees or impose obligations on us which cannot be excluded, restricted or modified. If those guarantees or obligations apply, then to the extent to which we are able to do so, we limit our liability for any breach of those guarantees or obligations to: (a) in the case of services, the supplying of the services again, or the payment of the cost of having the services supplied again; and (b) in the case of goods, the replacement of the goods or the supply of equivalent goods, the repair of the goods, the payment of the cost of replacing the goods or of acquiring equivalent goods, or the payment of the cost of having the goods repaired.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of New South Wales, Australia, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
